Der Teilnehmer nimmt an einer Fahrveranstaltung der AMAG Group AG und ihrer Konzerngesellschaften (Veranstalterin) teil. Mit seiner Unterschrift erklärt der Teilnehmer für und in Zusammenhang mit der Fahrveranstaltung folgendes:
am Anlass freiwillig und ausschliesslich auf eigene Gefahr teilzunehmen;
der Gefahren und Risiken der Teilnahme am Anlass bewusst zu sein, über diese Gefahren und Risiken ausreichend informiert worden zu sein und den erteilten Weisungen stets strikte Folge zu leisten;
bewusst zu sein, dass die teilnehmende Person die Teilnahme jederzeit beenden kann;
mindestens 21 Jahre alt zu sein;
gegenüber der AMAG Group AG und ihren Tochtergesellschaften (nachfolgend einzeln oder gemeinsam «AMAG») sowie gegenüber deren Organen, Angestellten, Vertretern und Hilfspersonen (nachfolgend einzeln oder gemeinsam «Hilfspersonen») auf sämtliche Haftungs- und Schadenersatzansprüche zu verzichten. Von diesem Verzicht ausgenommen sind Ansprüche aufgrund von Körperverletzungen, die AMAG oder ihren Hilfspersonen schuldhaft verursacht haben sowie aufgrund von Schäden, die AMAG oder ihren Hilfspersonen vorsätzlich oder grobfahrlässig verursacht haben sowie Ansprüche, die der teilnehmenden Person aufgrund zwingender gesetzlicher Bestimmungen zustehen;
Von der teilnehmenden Person schuldhaft verursachte Schäden zu ersetzen und die AMAG und ihre Hilfspersonen von sämtlichen Ansprüchen Dritter freizustellen, sofern deren Ansprüche auf ein Verschulden der teilnehmenden Person zurückzuführen sind;
Sich während des Anlasses bei der Nutzung von Geräten oder Fahrzeugen jeglicher Art (zu Lande, zu Wasser und in der Luft) an folgende Regelungen zu halten (sofern und soweit diese anwendbar sind):
a) während der Dauer des Anlasses nicht unter Alkohol-, Medikamenteneinfluss oder sonstiger berauschender Mittel zu stehen;
b) im Besitz einer allenfalls erforderlichen, zum Führen von entsprechenden Fahrzeugen gültigen Fahrerlaubnis am Ort des Anlasses zu sein und dem Veranstalter vor Anlassbeginn auf Verlangen Einsicht in die Fahrerlaubnis zu geben;
c) bei An- und Abfahrt zu Übungsplätzen sowie während allen Fahrten – als Fahrer wie auch Beifahrer – den Sicherheitsgurt anzulegen;
d) während des Anlasses allenfalls bestehende Überholverbote einzuhalten und hiervon nur nach vorheriger ausdrücklicher Aufforderung durch die Instruktoren abzuweichen;
e) bei Fahrten im öffentlichen Verkehr die Geschwindigkeitsbegrenzungen und alle weiteren geltenden Gesetze und Verordnungen einzuhalten;
Anerkennung und Einwilligung, dass die AMAG und ihre Hilfspersonen bei Verstössen gegen Verpflichtungen der teilnehmenden Person sowie zur Wahrung eigener Interessen berechtigt ist, den Namen der teilnehmenden Person jederzeit den zuständigen Behörden bekannt zu geben;
Im Fall der durch die teilnehmende Person zu vertretender Beschädigung der von der Veranstalterin zur Verfügung gestellten Fahrzeuge, hat die teilnehmende Person der Veranstalterin einen Betrag von bis zu CHF 1'000.00 zu erstatten. Sollte die teilnehmende Person Mitarbeiter/Mitarbeiterin der Veranstalterin sein und die zu vertretene Beschädigung der von der Veranstalterin zur Verfügung gestellten Fahrzeuge im Rahmen einer dienstlich veranlassten Veranstaltung erfolgt sein, gelten die Grundsätze der Arbeitnehmerhaftung aus der Arbeitsordnung der Veranstalterin. Der teilnehmenden Person ist der Nachweis gestattet, dass ein Schaden oder eine Wertminderung überhaupt nicht oder in wesentlich niedrigerem Umfang entstanden ist. Die Veranstalterin kann die teilnehmende Person von dieser Verpflichtung freistellen, wenn der Schaden bei einer Fahrübung entstanden ist, bei welcher sie nachweislich den Anweisungen des Instruktors Folge geleistet hat. Im Fall des vorsätzlichen oder grob fahrlässigen Verhaltens der teilnehmenden Person haftet sie für sämtliche von ihr verursachten Schäden. Grobe Fahrlässigkeit liegt insbesondere dann vor, wenn sie den Anordnungen eines Instruktors oder des Instruktoren-Teams keine Folge leistet.
Der teilnehmenden Person ist bekannt, dass zur Verdeutlichung einzelner im Rahmen des Fahrtrainings durchgeführter Übungen die Sicherheitssysteme ABS und ESP an den Trainingsfahrzeugen deaktiviert werden und er hierzu nur nach vorherigem ausdrücklichem Hinweis der Instruktoren berechtigt ist.
Im Falle eines Unfalls ist dieser der Veranstalterin unverzüglich, möglichst mittels des Audi Formulars „Fahrzeugunfall-/Schadensbericht“, mitzuteilen. Die teilnehmende Person ist nicht berechtigt, etwaige der Veranstalterin zustehende Forderungen oder Rechte an Dritte abzutreten. Etwaige der teilnehmenden Person infolge eines Schadensfalles zustehenden Ansprüche gegen Dritte auf Erstattung von Nutzungsausfall bzw. Mietwagenkosten tritt sie hiermit an die Veranstalterin ab, wenn diese ihm ein gleichwertiges Ersatzfahrzeug ohne zusätzliche Kosten zur Verfügung gestellt hat.
Die AMAG und ihre Hilfspersonen behalten sich das Recht vor, den Anlass aus wichtigen Gründen zu verschieben oder abzusagen. Eine allfällige Teilnahmegebühr wird in einem solchen Fall zurückerstattet. Weitergehende Ansprüche sind ausgeschlossen. Kann der Anlass nur in einzelnen Teilen durchgeführt werden, z. B. wegen schlechten Wetters oder höherer Gewalt, so wird eine allfällige Teilnahmegebühr entsprechend der erbrachten Leistungen angepasst.
Sollte eine teilnehmende Person ihre Anmeldung annullieren, gilt der nachfolgende Betrag als geschuldet:
über 60 Tage vor der Veranstaltung: kostenlos
31 bis 60 Tage vor der Veranstaltung: 50% der Teilnahmegebühr
30 Tage vor der Veranstaltung: 100% der Teilnahmegebühr
Lediglich schriftliche Abmeldungen werden anerkannt.
Die Veranstalterin schliesst im Zusammenhang mit der Benutzung der zur Verfügung gestellten Fahrzeuge eine Unfallversicherung ab:
Todesfall: CHF 100‘000.00
Invalidität: CHF 200'000.00
Heilungskosten private Abteilung in Ergänzung zur obligatorischen Grundversicherung
Die zur Verfügung gestellten Fahrzeuge sind für Fahrten auf dem vom Instruktor oder Kursleiter vorgegebenen Gelände und/oder der vorgegebenen Strecke während des Kurses unter Anweisung der Instruktoren oder Kursleiter von Beginn bis zum Schluss der Veranstaltung mit einer Vollkaskoversicherung versichert. Eventuelle Schäden sind unverzüglich dem zuständigen Instruktor oder Kursleiter zu melden.
Diese Teilnahmebedingungen und sämtliche Streitigkeiten, welche aus ihr bzw. aus meiner Teilnahme am Anlass resultieren oder damit im Zusammenhang stehen, unterstehen schweizerischem Recht unter Ausschluss internationaler Übereinkommen und kollisionsrechtlicher Normen. Gerichtsstand ist Cham (ZG), Schweiz.
The participant takes part in a driving event of AMAG Group AG and its group companies (organizer). With his signature, the participant declares the following for and in connection with the driving event:
to participate in the event voluntarily and exclusively at their own risk;
to be aware of the dangers and risks of participating in the event, to have been sufficiently informed about these dangers and risks and to always strictly follow the instructions given;
to be aware that the participating person may terminate participation at any time;
to waive all claims for liability and damages against AMAG Group AG and its subsidiaries (hereinafter referred to individually or collectively as "AMAG") as well as against their corporate bodies, employees, representatives and auxiliary persons (hereinafter referred to individually or collectively as "auxiliary persons"). Excluded from this waiver are claims based on bodily injury culpably caused by AMAG or its auxiliary persons as well as claims based on damage caused by AMAG or its auxiliary persons intentionally or through gross negligence as well as claims to which the participating person is entitled based on mandatory legal provisions;
To compensate for damages culpably caused by the participating person and to indemnify AMAG and its auxiliary persons against all claims of third parties, insofar as their claims are due to the fault of the participating person;
To comply with the following regulations (if and to the extent that they are applicable) when using equipment or vehicles of any kind (on land, on water and in the air) during the event:
a) not to be under the influence of alcohol, medication or other intoxicating substances for the duration of the event;
b) to be in possession of a valid driver's license at the location of the event, if required, and to give the organizer access to the driver's license upon request before the start of the event;
c) to wear the safety belt during the arrival and departure to the training areas as well as during all journeys - as driver as well as co-driver;
d) to observe any existing overtaking bans during the event and to deviate from these only after prior express request by the instructors;
e) to observe the speed limits and all other applicable laws and regulations when driving in public traffic;
Acknowledgement and consent that AMAG and its auxiliary persons are entitled to disclose the name of the participating person to the competent authorities at any time in the event of breaches of obligations by the participating person and in order to protect their own interests;
In the event of damage to the vehicles provided by the organizer for which the participating person is responsible, the participating person shall reimburse the organizer an amount of up to CHF 1,000.00. If the participating person is an employee of the organizer and the damage to the vehicles provided by the organizer for which the organizer is responsible has occurred in the context of an official event, the principles of employee liability from the work regulations of the organizer shall apply. The participating person shall be permitted to prove that no damage or a reduction in value has occurred at all or to a significantly lesser extent. The organizer may release the participant from this obligation if the damage occurred during a driving exercise during which the participant demonstrably followed the instructor's instructions. In case of intentional or grossly negligent behavior of the participating person, he/she is liable for all damages caused by him/her. In particular, gross negligence shall be deemed to have occurred if he/she fails to follow the instructions of an instructor or the instructor team.
In the event of an accident, this must be reported to the organizer immediately, if possible, using the Audi form "Vehicle accident/damage report". The participant is not entitled to assign any claims or rights to which the organizer is entitled to third parties. Any claims against third parties to which the participating person is entitled as a result of a damage event for reimbursement of loss of use or rental car costs are hereby assigned to the organizer if the organizer has provided him with an equivalent replacement vehicle at no additional cost.
The organizer shall take out accident insurance in connection with the use of the vehicles provided:
Death: CHF 100'000.00
Disability: CHF 200'000.00
Medical expenses private ward in addition to the obligatory basic insurance
The vehicles provided are insured for driving on the terrain and/or route specified by the instructor or course leader during the course under the instruction of the instructors or course leaders from the beginning to the end of the event with comprehensive insurance. Any damage must be reported immediately to the instructor or course leader in charge.
These conditions of participation and all disputes arising from them or from my participation in the event or in connection with them are subject to Swiss law, excluding international conventions and conflict of law rules. The place of jurisdiction is Cham (ZG), Switzerland.
Le participant prend part à une manifestation de conduite d'AMAG Group AG et des sociétés de son groupe (organisateur). Par sa signature, le participant déclare ce qui suit pour et en rapport avec la manifestation de conduite :
de participer volontairement et exclusivement à ses propres risques et périls à la manifestation ;
être conscient(e) des dangers et des risques liés à la participation à la manifestation, avoir été suffisamment informé(e) de ces dangers et risques et toujours suivre strictement les instructions données ;
être conscient que la personne participante peut mettre fin à sa participation à tout moment ;
être âgé d'au moins 21 ans;
de renoncer à toute prétention en responsabilité et en dommages-intérêts à l'égard du Groupe AMAG SA et de ses filiales (ci-après dénommées individuellement ou collectivement "AMAG") ainsi qu'à l'égard de leurs organes, employés, représentants et auxiliaires (ci-après dénommés individuellement ou collectivement "auxiliaires"). Sont exclus de cette renonciation les droits résultant de lésions corporelles causées par la faute d'AMAG ou de ses auxiliaires, ainsi que les droits résultant de dommages causés intentionnellement ou par négligence grave par AMAG ou ses auxiliaires, ainsi que les droits auxquels la personne participante peut prétendre en vertu de dispositions légales contraignantes ;
Réparer les dommages causés par la faute de la personne participante et libérer AMAG et ses auxiliaires de toutes les prétentions de tiers, dans la mesure où leurs prétentions sont imputables à une faute de la personne participante ;
Observer les règles suivantes (si et dans la mesure où elles sont applicables) pendant l’événement lors de l’utilisation d’appareils ou de véhicules de toute sorte (terrestre, maritime, aérien):
a. ne pas être sous l’emprise d’alcool, de médicaments ou d’autres substances psychotropes pendant l’événement
b. être en possession d’un permis de conduire en cours de validité pour conduire les véhicules concernés sur le lieu de l’événement et permettre à l’organisatrice de consulter sur demande ce permis avant le début du stage;
c. porter la ceinture de sécurité, en tant que conducteur et passager avant, au départ et à l’arrivée des places d’exercice ainsi que durant tous les parcours;
d. respecter l’interdiction de dépassement applicable pendant les séances d’essai et ne s’en écarter qu’après invitation explicite des instructeurs;
e. respecter les limitations de vitesse et toutes les autres lois et ordonnances en vigueur lors des parcours sur les routes ouvertes à la circulation;
Reconnaissance et accord pour qu'AMAG et ses auxiliaires soient autorisés à communiquer à tout moment le nom de la personne participante aux autorités compétentes en cas de violation des obligations de la personne participante ainsi que pour la défense de ses propres intérêts ;
En cas de dommages causés par la personne participante aux véhicules mis à disposition par l'organisateur, la personne participante doit rembourser à l'organisateur un montant allant jusqu'à CHF 1 000.00. Si la personne participante est un collaborateur/une collaboratrice de l'organisateur et que le dommage imputable aux véhicules mis à disposition par l'organisateur a eu lieu dans le cadre d'une manifestation organisée pour les besoins du service, les principes de la responsabilité des employés figurant dans le règlement de travail de l'organisateur s'appliquent. La personne participante est autorisée à prouver que le dommage ou la perte de valeur n'a pas eu lieu du tout ou qu'il est d'un montant nettement inférieur. L'organisateur peut libérer la personne participante de cette obligation si le dommage est survenu lors d'un exercice de conduite au cours duquel il est prouvé que la personne a suivi les instructions de l'instructeur. En cas de comportement intentionnel ou de négligence grave de la personne participante, celle-ci est responsable de tous les dommages qu'elle a causés. Il y a notamment négligence grave lorsqu'elle ne suit pas les instructions d'un instructeur ou de l'équipe d'instructeurs.
La personne participante est consciente que, pour illustrer certains exercices effectués dans le cadre du stage de conduite, les systèmes de sécurité ABS et ESP sont désactivés sur les véhicules d'entraînement et qu'elle n'y est autorisée qu'après en avoir été expressément informée par les instructeurs.
En cas d'accident, celui-ci doit être immédiatement signalé à l'organisateur, si possible au moyen du formulaire Audi "Rapport d'accident/de dommage au véhicule". La personne participante n'est pas autorisée à céder à des tiers d'éventuelles créances ou droits revenant à l'organisateur. La personne participante cède par la présente à l'organisateur les éventuels droits qu'elle peut faire valoir à l'encontre de tiers à la suite d'un sinistre pour le remboursement de la perte d'utilisation ou des frais de location d'un véhicule, si l'organisateur a mis à sa disposition un véhicule de remplacement de même valeur sans frais supplémentaires.
AMAG et ses auxiliaires se réservent le droit de reporter ou d'annuler la manifestation pour des raisons importantes. Dans un tel cas, les éventuels frais de participation seront remboursés. Toute autre revendication est exclue. Si la manifestation ne peut avoir lieu que dans certaines parties, par exemple en raison de mauvaises conditions météorologiques ou de force majeure, les éventuels frais de participation seront adaptés en fonction des prestations fournies.
En cas d’annulation d’inscription de la part du participant, le montant suivant sera considéré comme dû:
plus de 60 jours avant la manifestation: annulation gratuite
entre 31 et 60 jours avant la manifestation: 50% des frais de participation
30 jours avant la manifestation: 100% des frais de participation
Seules les désinscriptions annoncées par écrit sont acceptées.
L’organisatrice souscrit une assurance accident dans le cadre de l’utilisation des véhicules fournis:
Décès: CHF 100 000.00.–
Invalidité: CHF 200 000.00.–
Frais de soins médicaux en division privée en complément de l’assurance de base obligatoire
Les véhicules mis à disposition sont couverts par une assurance casco complète du début à la fin de la manifestation pour les trajets effectués sur le terrain et/ou le parcours prescrit par l'instructeur ou le responsable de cours pendant le cours, sous les instructions de l'instructeur ou du responsable de cours.
Les éventuels dommages doivent être signalés immédiatement à l'instructeur ou au responsable de cours compétent.Les présentes conditions de participation et tous les litiges résultant de la participation du/de la signataire à l’événement ou en lien avec ce dernier sont soumis au droit suisse à l’exclusion des conventions internationales et des normes du droit des résolutions des conflits de loi. Le for est Cham (ZG), Suisse.
Il partecipante prende parte a un evento di guida dell'esperienza di AMAG Group AG e delle sue società del gruppo (organizzatore). Con la sua firma, il partecipante dichiara quanto segue per e in relazione all'evento di guida:
di partecipare volontariamente ed esclusivamente a suo rischio e pericolo all'evento;
di essere consapevole dei pericoli e dei rischi legati alla partecipazione all'evento, di essere stato sufficientemente informato di questi pericoli e rischi e di seguire sempre rigorosamente le istruzioni date;
di essere consapevole che il partecipante può interrompere la sua partecipazione in qualsiasi momento;
avere almeno 21 anni;
di rinunciare a tutte le richieste di responsabilità e di risarcimento danni contro il Gruppo AMAG AG e le sue filiali (di seguito denominate singolarmente o collettivamente "AMAG") e i loro organi, dipendenti, rappresentanti e agenti (di seguito denominati singolarmente o collettivamente "agenti"). La presente rinuncia non si applica alle rivendicazioni derivanti da lesioni personali causate per colpa di AMAG o dei suoi ausiliari, né alle rivendicazioni derivanti da danni causati intenzionalmente o per grave negligenza da parte di AMAG o dei suoi ausiliari, né alle rivendicazioni a cui il partecipante ha diritto in base a disposizioni legali obbligatorie;
Per risarcire i danni causati dalla colpa del partecipante e per indennizzare AMAG e i suoi ausiliari da tutte le pretese di terzi, nella misura in cui le loro pretese sono attribuibili alla colpa del partecipante;
Osservare le seguenti regole (se e nella misura in cui sono applicabili) durante l'evento quando si utilizzano attrezzature o veicoli di qualsiasi tipo (terra, mare, aria)
a. non essere sotto l'influenza di alcool, droghe o altre sostanze psicotrope durante l'evento
b. essere in possesso di una patente di guida valida per guidare i veicoli in questione nel luogo della manifestazione e permettere all'organizzatore di consultare tale patente su richiesta prima dell'inizio del corso
c. Indossare la cintura di sicurezza, come conducente e passeggero anteriore, all'inizio e alla fine dei luoghi di esercizio e durante tutti i percorsi;
d. rispettare il divieto di sorpasso applicabile durante le sessioni di prova e discostarsene solo dopo esplicito invito da parte degli istruttori;
e. rispettare i limiti di velocità e tutte le altre leggi e regolamenti applicabili quando si guida su strade aperte al traffico;
Riconoscimento e accordo che AMAG e i suoi assistenti sono autorizzati a trasmettere il nome del partecipante alle autorità competenti in qualsiasi momento in caso di violazione degli obblighi del partecipante e per la difesa dei propri interessi;
In caso di danni causati dal partecipante ai veicoli messi a disposizione dall'organizzatore, il partecipante deve rimborsare l'organizzatore fino a CHF 1'000.00. Se il partecipante è un dipendente dell'organizzatore e i danni ai veicoli messi a disposizione dall'organizzatore si sono verificati nell'ambito di una manifestazione organizzata ai fini del servizio, si applicano i principi della responsabilità dei dipendenti stabiliti nel regolamento di lavoro dell'organizzatore. Il partecipante ha il diritto di provare che il danno o la perdita di valore non si sono verificati affatto o sono stati di un importo significativamente inferiore. L'organizzatore può liberare il partecipante da questo obbligo se il danno si è verificato durante un esercizio di guida in cui è dimostrato che il partecipante ha seguito le istruzioni dell'istruttore. In caso di comportamento intenzionale o gravemente negligente da parte del partecipante, quest'ultimo è responsabile di tutti i danni da lui causati. La negligenza grave include il mancato rispetto delle istruzioni di un istruttore o del team di istruttori.
Il partecipante è consapevole che i sistemi di sicurezza ABS e ESP sui veicoli di addestramento sono disattivati allo scopo di dimostrare determinati esercizi durante il corso di guida e che gli è consentito farlo solo dopo esserne stato espressamente informato dagli istruttori.
In caso di incidente, questo deve essere segnalato immediatamente all'organizzatore, se possibile utilizzando il modulo Audi "Accident/Damage to Vehicle Report". Il partecipante non è autorizzato a cedere a terzi le pretese o i diritti dell'organizzatore. Il partecipante cede all'organizzatore tutti i diritti che può avere nei confronti di terzi a seguito di un incidente per il rimborso della perdita di utilizzo o delle spese di noleggio di un veicolo, se l'organizzatore ha fornito un veicolo sostitutivo di pari valore senza costi aggiuntivi.
AMAG e i suoi assistenti si riservano il diritto di rinviare o annullare l'evento per motivi importanti. In questo caso, la quota di partecipazione sarà rimborsata. Qualsiasi altro reclamo è escluso. Se l'evento può svolgersi solo in determinate zone, ad esempio a causa di condizioni meteorologiche avverse o di forza maggiore, le eventuali quote di partecipazione saranno adeguate in base alle prestazioni fornite.
In caso di cancellazione dell'iscrizione da parte del partecipante, il seguente importo sarà considerato come dovuto:
più di 60 giorni prima dell'evento: cancellazione gratuita
tra 31 e 60 giorni prima dell'evento: 50% della quota di partecipazione
30 giorni prima dell'evento: 100% della quota di partecipazione
Saranno accettate solo le cancellazioni scritte.
L'organizzatore stipulerà un'assicurazione contro gli infortuni per l'uso dei veicoli forniti:
Morte: CHF 100 000.00
Invalidità: CHF 200'000.00
Costi delle cure mediche in un reparto privato in aggiunta all'assicurazione di base obbligatoria
I veicoli forniti sono coperti da una polizza assicurativa completa dall'inizio alla fine dell'evento per i viaggi effettuati sul terreno e/o sul percorso prescritto dall'istruttore o dal capocorso durante il corso, sotto le istruzioni dell'istruttore o del capocorso.
Queste condizioni di partecipazione e tutte le controversie derivanti da o in relazione alla partecipazione del firmatario alla manifestazione sono soggette al diritto svizzero, ad esclusione degli accordi internazionali e delle norme di conflitto di leggi. Il luogo di giurisdizione è Cham (ZG), Svizzera.
